1. Acceptance of these terms
These Terms of Use are an agreement between you and Reality Web Services, LLC (“TheMarketshop,” “we,” “us,” or “our”) covering themarketshop.com and the content and applications published on it. By accessing or using the site, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.
2. What this site is
TheMarketshop.com publishes browser-based apps and utilities, games, coding tutorials and sample projects, blog posts about AI and technology, recipes, travel guides, and links to products and services. Much of it is experimental and offered free of charge. Features may be added, changed, or removed at any time, and any app on the site may be discontinued without notice.
3. Permitted use
You may use the site for lawful personal, educational, and internal business purposes. You agree not to:
- use the site in violation of any applicable law or regulation;
- interfere with, disrupt, probe, or attempt to gain unauthorized access to the site, its servers, its databases, or another user's account;
- scrape, crawl, or harvest the site at scale, or use automated tools in a way that places an unreasonable load on our infrastructure;
- circumvent usage limits, credit systems, paywalls, rate limits, or access controls;
- upload or submit content that is unlawful, infringing, malicious, or that contains malware;
- remove, obscure, or interfere with advertising or attribution; or
- resell or commercially redistribute the site's content or tools as your own product.
4. Accounts
Most of the site works without an account. Where an application does offer one, you agree to provide accurate information, to keep your credentials secure, and to accept responsibility for activity that occurs under your account. Tell us promptly if you believe your account has been compromised. We may suspend or terminate an account we reasonably believe is being misused, shared improperly, or used to abuse the service.
5. Your content and your files
Many of our tools — CleanPic, Social Image Maker, Dropsheet, CueFlow Teleprompter, Atlas Motion, and others — run entirely in your browser and never upload your files to us. You keep all ownership of the photos, spreadsheets, scripts, videos, quizzes, and other content you create or process, and you are responsible for having the rights to use it.
Because these tools run locally, we have no copy of your work. We cannot recover it if you clear your browser data, switch devices, or lose a file. Keep your own backups of anything that matters.
Where an application does store content on our servers — for example a saved quiz, a saved search, or a diary entry — you grant us only the limited permission needed to store, process, and display that content back to you in order to operate the feature. We do not claim ownership of it.
6. Tutorials, sample code, and projects
Code samples, tutorials, and project write-ups are published for learning purposes. They are illustrative rather than production-hardened, may age as underlying platforms and APIs change, and may not follow current security best practices for your environment. Review, test, and adapt anything you take from here before using it in production. You are responsible for how you use it and for complying with the licenses of any third-party libraries involved.
7. Purchases, credits, and subscriptions
Most of the site is free. A few applications sell credits or paid plans. Where they do, payment is processed by Stripe, prices and free-usage allowances may change over time, and the specific terms of that application govern the purchase. Except where required by law, credits are intended for use on the site and are generally non-refundable once applied. Products with their own terms include Deal Finder Pro, QuickCut Studio, and PickleBoost; QuizLink Pro and PickleBooster operate on their own domains under their own terms. Where those terms conflict with these, the product-specific terms control for that product.
8. Advertising and affiliate disclosure
This site displays advertising, including Google AdSense, and contains affiliate links to retailers — among them links placed under the Amazon Associates Program. If you click an affiliate link and make a qualifying purchase, we may earn a commission at no additional cost to you. As an Amazon Associate we earn from qualifying purchases.
Advertisements are served by third parties. Their appearance on this site is not an endorsement, and we are not responsible for the products, claims, or practices of advertisers.
9. Third-party links and services
The site links to retailers, map providers, payment processors, video platforms, AI services, and other outside websites. We do not control them, we are not responsible for their content, availability, pricing, or practices, and your use of them is governed by their terms and privacy policies. Prices, stock levels, and deal information shown anywhere on this site come from third-party sources, can change quickly, and should always be verified with the retailer before you buy.
10. No professional advice
Recipes, nutrition and wellness content, fitness and training material, travel guidance, and product recommendations on this site are provided for general information and entertainment. They are not medical, nutritional, financial, legal, or professional advice. Consult a qualified professional before making decisions about your health, diet, exercise, or finances, and check ingredients and allergens yourself before cooking or eating anything.
11. Intellectual property
The site's design, text, graphics, logos, and original software are owned by Reality Web Services, LLC or its licensors and are protected by copyright and other laws. You may view pages, use the tools, and quote or share short excerpts with attribution and a link. You may not copy the site wholesale, republish its content as your own, or use our name or branding in a way that suggests affiliation or endorsement without permission. Third-party libraries, fonts, and map data used on the site remain the property of their respective owners and are used under their own licenses.
If you believe material on this site infringes your copyright, contact us with enough detail to identify the work and the page, and we will review and respond.
12. Disclaimers
The site and everything on it is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the site will be uninterrupted, timely, secure, or error-free; that results or output will be accurate or reliable; or that defects will be corrected. Automated and AI-assisted features can produce incorrect or incomplete results and should be reviewed before you rely on them.
13. Limitation of liability
To the fullest extent permitted by law, Reality Web Services, LLC and its owners and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost work product, or business interruption, arising out of or relating to your use of the site — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the site will not exceed the greater of the amount you paid us for the service giving rise to the claim in the twelve months before the claim, or one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations or exclusions of liability, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited, or any consumer rights that applicable law grants you.
14. Indemnification
You agree to indemnify and hold harmless Reality Web Services, LLC from claims, damages, liabilities, and reasonable expenses arising out of your misuse of the site, your violation of these terms, or your infringement of someone else's rights.
15. Suspension and termination
We may suspend, limit, or terminate your access to the site or any application on it, with or without notice, if we reasonably believe you have violated these terms or are using the site in a way that harms the site, other users, or third parties. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
16. Governing law
These terms and any dispute arising out of them or your use of the site are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Pennsylvania have exclusive jurisdiction over such disputes, except where applicable consumer-protection law gives you the right to bring a claim in your own jurisdiction.
17. Changes to these terms
We may update these terms as the site changes. The effective date at the top will be updated when a new version is published, and continued use of the site after that means you accept the updated terms. If a provision is found unenforceable, the rest remains in effect.
